Subprocessors
Version 2026-10-21. Effective .
This page lists the companies that process personal information for Third Space LLC, a Wyoming limited liability company ("Third Space", "we" or "us"), when we run Background Noises: our service provider, the companies that work under it or beside it, what each receives, where, and who engages it. It supplements our Privacy Policy. It is information, not a contract.
1. How we use providers
A service provider (sometimes called a subprocessor or processor) is a company that processes personal information for us, under our instructions and under terms that limit its use of the information to providing its service to us and, where those terms allow, keeping its service secure, preventing fraud and meeting its legal obligations. Third Space decides how and why the information is used. We do not sell or share personal information, and we do not use it for targeted advertising. "See provider" means the provider's own policy says where it processes data. "Engaged by" says whether we contract with the company ourselves or our service provider does, as its own subprocessor, to run the Service for us.
2. Our service provider: eleMusic Inc.
eleMusic Inc., a Delaware corporation ("eleMusic"), runs the stream of music and sound, the account service and the rendering of the noise colors and the tones for us, under a service agreement and a data processing agreement. It is a separate company: Background Noises plays music and sound streamed by eleMusic, a separate service. It processes personal information only on our instructions and only to run the Service, and it engages some of the companies in Section 3 as its own subprocessors to do so.
| Provider | What it does for us | Personal information involved | Where | Privacy policy |
|---|---|---|---|---|
| eleMusic Inc. | Runs the account and sign-in service, the catalog and playback service the players call (the stream of music and sound), and the rendering of the noise colors and the tones; makes the music and nature stations in advance (Section 5). | Account information, sign-in records, plans and purchase identifiers, consent and Terms records, listening records and saved listening sessions, support requests about the service, and the IP address and browser or device type of requests. | United States for the account service, its database and the audio; for the playback service and the rendering, see Modal (Section 3) | elemusic.fm/privacy |
3. The companies behind the service
| Provider | What it does | Personal information involved | Engaged by | Where | Privacy policy |
|---|---|---|---|---|---|
| Render | Hosts the account and sign-in service and its Postgres database, and this website, through its edge network operated by Cloudflare, Inc. | Account information, sign-in records, plans and purchase identifiers, consent and Terms records, listening records, and the IP address and browser or device type of requests. | Third Space (our Render team); eleMusic runs the service in it. | See provider | render.com/privacy; cloudflare.com/privacypolicy |
| Modal | Runs the catalog and playback service the players call, and the service that renders the noise colors and the tones. | Your place in each sound's play order, the account identifier the play token carries, and the IP address and device or browser type of requests. | eleMusic | See provider | modal.com/legal/privacy-policy |
| Amazon Web Services (Amazon S3) | Stores the audio and delivers it to your devices through time-limited links. | The IP address and device or browser type of each request for audio. | Third Space (our AWS account); eleMusic writes the audio to it. | United States (us-west-2) | aws.amazon.com/privacy |
| Stripe | Checkout, subscriptions, invoices, the billing portal and payment processing for plans bought on the web. Stripe also uses some of this information as an independent company under its own privacy policy, for example to prevent fraud. | Email address, name, billing address, card details, and the IP address and device information Stripe collects on its pages; our account identifiers. | Third Space (our Stripe account) | See provider | stripe.com/privacy |
| Resend | Sends account email, such as password reset links. | Your email address and the message. | eleMusic | See provider | resend.com/legal/privacy-policy |
| Sentry | Error and crash reports from the servers that run the Service and, where an app sends them, from the apps. | Error reports, timings, and device, browser and operating system type. Email addresses, passwords and sign-in tokens are removed from the servers' reports, and the sign-in token from the apps', before they are sent. | Third Space (our Sentry organization) | United States | sentry.io/privacy |
| Google Workspace | Our email at the thirdspaced.com addresses, joshua@thirdspaced.com for support and privacy@thirdspaced.com for privacy requests. | Whatever you send us by email: your name, email address and message contents. | Third Space (our mailboxes) | See provider | policies.google.com/privacy |
| Expo (EAS Update) | Delivers updates to the Background Noises apps. | Device operating system, the app's project identifier, an installation identifier, and the IP address of requests. | Third Space | See provider | expo.dev/privacy |
4. Companies that act for themselves
These companies handle information under their own terms and privacy policies, not as our service providers:
- Google, when you choose Sign in with Google (it gives us your account identifier, verified email address and name), when you use Google Cast, and when you get the Android app or buy a plan through Google Play (policies.google.com/privacy). Sign in with Google uses a Google Cloud project whose consent screen names Third Space.
- Apple, when you choose Sign in with Apple (it gives us an account identifier, an email address, which may be a private relay address, and the name you share), when you get the iPhone and iPad app or buy a plan in the App Store, and when you use AirPlay (apple.com/legal/privacy).
- Stripe, for the uses its own privacy policy describes (Section 3).
5. How the music is made
The music stations are generated in advance by eleMusic with AI models, including models from Google offered through the Gemini API, and then selected, checked and mastered by eleMusic; the nature stations are assembled by eleMusic from sound effects generated with third-party AI models. The companies that provide those models receive only the instructions eleMusic writes. Neither we nor eleMusic send them your personal information, and neither uses it to make sounds or to train AI models.
6. Changes to this list
We update this page before a new or replacement provider receives personal information. Adding or replacing a provider for a purpose the Privacy Policy already describes is not a material change; for a material change we give the notice that Section 15 of the Privacy Policy describes.
This is version 2026-10-21 of this list, effective October 21, 2026. Earlier versions are listed in the Legal Center and available on request at joshua@thirdspaced.com.
