The documents that govern Background Noises, their versions, and the versions before them.

Background Noises is operated by Third Space LLC, a Wyoming limited liability company; the music, sound and account service behind it is run for us by eleMusic Inc., a separate company. These are the documents that govern it: what each one covers, its version and effective date, what changed and when, and how to get the versions that came before.

The documents

  • Terms of Service. Your agreement with Third Space LLC for the apps, the web player, plans and the sounds. Version 2026-10-21, effective October 21, 2026.

Change log

  • : The service agreement and the data processing agreement between Third Space LLC and eleMusic Inc. took effect: eleMusic Inc. runs the stream, the account service and the rendering for Third Space LLC, on its instructions, and Third Space LLC remains responsible for Background Noises and for your personal information.
  • : The credit balances copied on October 19, 2026 were corrected: only credits bought and not used count, and they are held on each account. Third Space LLC refunds those bought on the web or on Google Play on request, and Apple decides refunds of those bought in the App Store. Credits that were not bought cannot be used.
  • : The service provider behind Background Noises changed. Accounts were copied from the earlier service, which Third Space LLC ran itself, to the service eleMusic Inc. now runs for it: accounts, the ways you sign in, subscription records, whether the earlier service recorded you as agreeing to marketing email, whole credit balances and saved Beat Builder presets, which stay with each account although nothing uses them while the Beat Builder is paused. Background Noises is still Third Space LLC's; nothing was sold or transferred to another company. The earlier service keeps running for apps that have not taken the latest update, and accounts made there in the meantime are copied too.

They are not republished here. For a copy of either, write to joshua@thirdspaced.com. Section 4.3 of the Terms of Service says when the terms you accepted before still apply to you.

Apps that have not taken the latest update still connect to the earlier service, which these documents cover, until it closes.

Each document shows its version and its effective date at the top. When a new version takes effect, the one it replaces stays available at its own address, such as /terms-2026-11-20 for a Terms of Service version 2026-11-20, and this list links it.
